A lawsuit has been filed seeking damages after an Alabama crash that killed Grammy nominated R&B singer Angie Stone.

According to the Associated Press, the suit was filed in Georgia by crash survivor Sheila Hopkins, and Stone’s two children, Diamond Stone and Michael D’Angelo Archer.

The wreck occurred on March 1 as Stone and her band were returning to Atlanta after performing at a Mardi Gras Ball in Mobile.

The lawsuit says the driver lost control of the Mercedes Benz Sprinter van carrying Stone and the band causing the vehicle to flip over on the highway.

After the initial accident Stone and others were alive but needed assistance to exit the vehicle from drivers who pulled over.

“Stone was still trying to get out when an 18-wheeler carrying a load of sugar slammed into the van, the lawsuit says,” the Associated Press wrote.

“That impact ejected Stone and pinned her under the van, where she died, the lawsuit claims.”

Hopkins was also in the van when the truck collided but survived with injuries.

Defendants in the case include the van driver, owners of the van, the truck driver, the trucking company and manufacturer of the truck.

The lawsuit alleges the truck had a faulty collision avoidance system and the truck driver was not paying attention as the truck slammed into the van at about 70 miles per hour.

Stone was a three-time Grammy nominee and two-time winner of the Soul Train Lady of Soul award.

She was a member of the all-female hip-hop trio The Sequence, which formed in 1979 in South Carolina and released notable single “Funk You Up,” which has been sampled by Dr. Dre and other artists since then. Her career as a solo artist blossomed in the 2000s, with hit songs like “Wish I Didn’t Miss You” and “No More Rain (In This Cloud).”

Isadore Sims, Mobile-Area Mardi Gras Association President, called Stone’s final performance at the Mobile Mardi Gras Ball “nothing short of phenomenal” after learning of her unexpected passing.
